General prohibitions
Customer will not, and will not permit anyone to use the Service to:
- engage in any unlawful, fraudulent, or deceptive activity;
- violate any applicable law, regulation, or court order, including consumer-protection, privacy, anti-discrimination, employment, tax, or trade laws;
- infringe any third party’s intellectual property rights;
- harass, threaten, defame, stalk, or intimidate any person;
- generate, distribute, or store child sexual abuse material;
- generate, distribute, or store hate speech, content inciting violence, or content that promotes terrorism;
- generate or distribute non-consensual intimate imagery or “deepfake” depictions of real persons;
- impersonate any person or business, including by using AI voice that mimics a real person’s voice or vocal style without that person’s clear, documented consent;
- generate fraudulent reviews or testimonials.
Voice and SMS
The Service includes outbound and inbound voice and SMS capabilities. Customer is solely responsible for compliance with the Telephone Consumer Protection Act (“TCPA”), state two-party-consent recording laws, do-not-call laws, and 10DLC and similar carrier requirements.
Customer will:
- obtain all required prior consent (express written consent where applicable) before placing outbound calls or SMS, including AI-initiated calls and SMS;
- maintain accurate, current do-not-call and opt-out lists, and respect every opt-out request promptly (and in any event within ten (10) business days for SMS);
- restrict calling and messaging to legally permitted hours of day under federal and state law;
- ensure that the AI-disclosure announcement and recording-consent disclosure shipped with BOS remain enabled at the start of voice interactions and are not modified to be misleading;
- not use the Service for ringless voicemail drops, robodialing without consent, predictive dialing without consent, or “neighbor spoofing”;
- not use the Service to impersonate a regulated profession (e.g., a licensed attorney, physician, or financial advisor) the Customer is not authorized to practice;
- not use the Service to clone or replicate the voice of a real person without that person’s documented consent.
The Service may be used to send and receive email. Customer is responsible for compliance with the CAN-SPAM Act and any state, provincial, or international anti-spam law that applies.
Customer will:
- ensure outbound commercial email is accurately attributed to Customer’s business;
- include a working unsubscribe mechanism in commercial messages;
- honor unsubscribe requests within ten (10) business days;
- include the Customer’s physical postal address in commercial messages;
- not use harvested or unconsented address lists;
- not engage in cold outreach in jurisdictions where local law prohibits it.
Prohibited industries
Dino RD&C does not knowingly sell the Service to, or permit the Service to be used for the operation of, businesses in the following categories:
- adult content, pornography, or sex work platforms;
- firearms, ammunition, or explosives manufacturing or distribution;
- gambling, online gaming, sports betting, or fantasy-sports operators;
- cannabis, CBD, or similar regulated plant-derived products (regardless of state-level legalization, due to multi-state compliance complexity);
- debt collection (third-party collection of consumer debt);
- payday, short-term, or high-interest consumer lending;
- multi-level marketing, pyramid schemes, or chain referral schemes;
- cryptocurrency, digital-asset issuance, or unregistered securities offerings;
- counterfeit or replica goods;
- bail bonds;
- get-rich-quick, business-opportunity, or speculative investment schemes;
- products or services that make unverified medical, health, or therapeutic claims;
- any other industry that Dino RD&C identifies in writing as out of scope of the Service.
If Customer’s business changes during the term of the Terms of Service such that Customer falls into one of the categories above, Customer will notify Dino RD&C and the parties will discuss whether continued use of the Service is appropriate.
System integrity and security
Customer will not:
- attempt to circumvent, disable, or interfere with security or license-enforcement features of the Software or Appliance;
- introduce malware, viruses, ransomware, or other harmful code into the Service or other systems through the Service;
- conduct vulnerability or penetration testing of Dino RD&C-controlled infrastructure without prior written authorization (see Security Disclosure Policy);
- attempt to access another customer’s Appliance or data;
- engage in any activity that interferes with or disrupts the Service or the networks connected to the Service;
- excessively burden the Service or any third-party platform connected through the Service.
Resale, multi-tenancy, and competing development
Customer will not:
- operate the Service as a multi-tenant offering for the benefit of third parties;
- resell, sublicense, white-label, or otherwise make the Service available to third parties (except as expressly permitted under the Terms of Service and EULA);
- use the Service to develop, train, or improve a product that competes with Dino RD&C;
- reverse engineer the Service for any reason except as permitted by applicable law notwithstanding the EULA’s restriction.
Enforcement
7.1 Investigation. Dino RD&C may investigate suspected AUP violations and may, while investigating, suspend support, updates, and cloud-relay services.
7.2 Suspension. Dino RD&C may suspend any portion of the Service immediately if continued operation poses a security risk, a risk to Dino RD&C, a risk to a third-party platform, or a risk of significant harm to a third party.
7.3 Termination. Material AUP violations not cured within 30 days of written notice are grounds for termination of the Terms of Service. No refunds are payable on AUP termination.
7.4 Cooperation. Dino RD&C will reasonably cooperate with valid law-enforcement and platform-trust requests.
